Device Financing Services Facilitated Through EMI Manager
These Terms & Conditions (“Terms”) govern your use of the device financing facilitation services provided through EMI Manager, a service operated by Ambala IT. By accepting these Terms, you (“Customer”) agree to comply with and be legally bound by the following conditions.
By availing device financing services through EMI Manager, you confirm that you have:
EMI Manager is a device financing facilitation platform provided by Ambala IT to retailers. EMI Manager does not sell, lease, or finance devices directly to Customers.
The hire purchase or installment financing agreement is strictly between you and the retailer from whom you purchase the device. EMI Manager acts solely as a technology and service facilitator. Ambala IT is not a lender, financier, or party to the financing contract unless explicitly stated.
Upon approval of financing and execution of the retailer agreement, the handset and all associated accessories will be delivered to you directly by the retailer. Product condition, warranty, or defect issues must be addressed with the retailer.
You agree to:
Failure to make timely payments may result in forfeiture of ownership rights, mandatory return of the device, or loss of refund eligibility as per retailer agreement.
In case of default or non-payment, the retailer may restrict device usage, initiate recovery proceedings, or recover associated legal and administrative costs as permitted by law.
EMI Manager and Ambala IT are not directly responsible for recovery actions but may provide operational assistance to the retailer.
You agree to cooperate fully with the retailer and authorized agents in recovery proceedings and provide lawful access for device retrieval where permitted.
You are solely responsible for any fraudulent or illegal activity conducted using the financed device. Neither the retailer nor Ambala IT shall be liable for misuse or violations of law.
You agree to provide accurate contact and identification details and notify the retailer of any changes.
EMI Manager may process and share necessary information strictly for service facilitation, payment tracking, compliance, and enforcement purposes in accordance with applicable laws.
The retailer reserves the right to amend financing terms in compliance with law. Ambala IT may update service terms as required. Continued use constitutes acceptance of revised Terms.
These Terms shall be governed by applicable laws of the retailer’s place of business. Disputes shall be subject to competent courts under applicable law.
If any provision is found invalid, remaining provisions shall continue in full force and effect.
These Terms, along with the retailer financing agreement, constitute the entire understanding between the parties.
By proceeding with the financing arrangement, you acknowledge that you understand and agree to these Terms & Conditions.
